我的美国EB1A杰出人才移民办理历程

我在上海某国企任职,担任总工程师,收入不错,工作也不累。原本没想过移民,因为我的英语也一般,到国外生活不太方便。2014年我的邻居移居美国,当时有了移民的念头,但也没有正式实施。2015年底女儿上初中,我们原本的打算是让她去美国读大学。凑巧听了某留学机构的讲座,建议孩子去美国读中学更容易进入名校。就这一个孩子远离父母孤身去美国读书,真的舍不得。于是移民正式提上日程。

一开始考虑的是投资移民,50万美金虽然不少,把股票卖了也能拿出来,但是当时已经要排期了,而且EB5还有失败的风险,研究来研究去就了解到EB1A杰出人才。当时就在网上到处找杰出人才的相关信息,联系各种中介机构。那时也考虑委托美国的律师,但是因为时差,沟通很费劲,于是决定从国内找。上海移民中介很多,也对比了很多家,但价格还是觉得贵,都要30万-50万人民币,比美国律师收费高很多。很偶然的机会发现了91移民网,发现很多原创的文章,学到很多知识。跟梁律师聊了下感觉也还行,几经考虑都没跟律师见过面最终签约。

我的条件是符合杰出人才的基本要求的,但是自认为不算优秀。有几篇论文,但都是中文,当时就是为了评职称,没什么技术含量。别的评审、收入、行业协会也都有,但不出彩。唯一出彩的就是有一个国家级奖项,梁律师写材料也是围绕这个奖项组织的,最终也证明效果很好。杰出人才需要很多的证明材料,如果决定要申请,一定要提前积累。像我参加了很多项目评审,但是因为没有留存当时的邀请函,最后又费了很多功夫补了评审材料。

我的运气真的不错,递件后5个月收到了移民局获批通知。当时EB1A还没有排期,一年左右nvc填表,一年半广州面试都很顺利。据律师讲只要140过了,其他的都是走流程,当然最后结果真的很好。最后一共花了几万块就成功拿到绿卡,真的超值。我的经历很有代表性,大部分杰出人才移民的申请人可以称为优秀,但算不上杰出,可只要律师靠谱+运气不错还是能拿到美国绿卡的。

美国杰出人才移民EB1a申请难不难?

这个问题经常被问到,可见申请人非常关心。我在网上搜索相关答案,大相径庭。有的说很容易,这个答案大部分来自移民中介,有的说很难。我认为这个问题本身并没有意义,因为申请人情况不一样。有的申请人条件一般,但是一次性通过,有的人条件很好,但是补件不过,你如果问前者,那么他会说很容易,你问后者,他会说很难。

因为存在幸存者偏差,这个问题是没有准确答案的,并且答案对于准申请人并没有任何参考价值。这个问题我认为用值不值来衡量更加准确。参考加拿大雇主担保的价格,考虑到美国绿卡难度更高,我对美国绿卡的估值是150万人民币,如果你符合EB1A签证的要求,那么用5万以内的成本去尝试一下,你认为值不值呢?答案每个人并不一样。认为值得,就抓紧时间联系靠谱的律师,因为申请难度大方向是越来越高的。认为不值,就看看别的国家,别的类别,或者安心在国内呆着也挺好的。

恭喜北京w先生EB1A杰出人才获批

W先生是北京某高校副教授,2018年第一次申请,经补件遗憾被拒。今年第二次提交申请,无补件获批。同一位客户,同样的材料,不同的移民官审理不同的结果。所以只要条件满足要求的申请人,建议多次申请。

因为移民局通知是通过平信寄出,丢件率较高,再次吐槽一下,已经9102年了,移民局还在通过邮寄的方式发送通知,而提供的邮箱只是一个摆设,如果需要补件,你的邮箱会受到邮件通知,但是邮件里并没有补件内容,补件内容还是要看邮寄的通知。

未收到通知信有两种情况,一种是不知道自己的申请号Receipt Number,另一种已经知道Receipt Number。

第一种情况比较麻烦,你只能通过致电USCIS查询申请号。电话:1-800-375-5283 or 1-800-767-1833 (TTY)

在移民材料寄出后如果超过一个月还没有收到通知信就应该打电话查询了。注意这个电话非常难打,不是没人接听,就是占线,充分展现了移民局的高大形象,拨打电话前一定调整好心理状态。通常需要几天时间才能打通,需要回答申请提交时间、申请人生日等问题查询到Receipt Number。

美国国家利益豁免移民niw的申请条件

最基本条件:高等学位或者特殊技能

由于国家利益豁免属于职业移民第二优先(EB-2),申请人必须符合申请EB-2的条件,也就是拥有高等学位或者特殊技能。

高等学位即指美国或者外国相等大学的硕士或以上学位或者同等学力,比如M.A.,M.S.,M.E.,M.D.或Ph.D.,并且在需要的高等学位的工作领域内工作,或者是在传统的专业领域内工作,比如律师、医生、建筑师、工程师或教师。学士学位另加五年相关专业领域的工作经验者也算满足高等学位的要求。

如果没有高等学位,申请人也可以宣称拥有特殊技能,也就是在科学、艺术或商业领域,拥有超过一般同行的特殊技能,满足以下要求中的至少三条:
1、在其专业领域内曾经获得过学院、大学或其它教育培训机构颁发的官方学术证明;
2、在其专业领域内有十年以上的全职工作经验,这一项一般需由前任及现任雇主提供证明;
3、有在相关领域的专业从业执照;
4、申请人由于自己的特殊技能所获得薪水或其它报酬特别高;
5、申请人是专业协会的会员;

6、在所在的领域内获得认可,并做出重要的贡献。这一点由同事、政府机关、专业或者商业组织提供证明。
7、申请人只需要符合高等学位或者特殊技能其中一个条件既可,不必同时符合两个条件。
 当然,根据移民局行政上诉办公室(AAO)声称,高等学位或者特殊技能只是申请国家利益豁免的「基本标准」,申请人还必须满足另外一些国家利益豁免的特殊标准,即AAO在纽约州交通部案(NYDOT)中所确立的衡量国家利益的三重标准。

1、申请人的工作及所从事的领域必须与美国国家利益有内在的实质性的联系;
一般说来,几乎所有的工作都可以和美國國家利益有某种联系,各科研领域、工程、艺术、学术、教育、金融、体育、出版、电影、音乐等均可和美國國家利益联系起来。想要证明这一点是比较容易的。
2、申请人所从事的工作及贡献必须在美国全国范围内产生有益的影响,而不是仅对某一个州某一个城市,或者某一个人产生影响;

一般说来,想要证明这一点也是比较容易的。比如说,您在全国范围发行的期刊上发表过文章、在国家级会议上做过演讲、在联邦资助的国家性项目中担任重要角色、是一个专利的发明人、或者您工作的单位为国家生产非常重要的新产品。
3、如果要求申请人通过劳工证申请移民,就会有损于美国国家的利益。

这一点为国家利益豁免申请的最难点。劳工证的设置是为了保护美国工人的基本利益,只证明申请人的能力高于有类似背景的美国同行,对国家利益做出的贡献超过了保护美国劳工利益的需要,那么申请人就可以获得国家利益豁免。

综上所述,申请人最终需要证明的就是,他/她的工作和贡献可以为全美国带来巨大的利益,这种巨大的利益超过了美国政府保护美国劳工利益的需要,出于国家利益的考虑,美国政府同意豁免直劳工证的申请,容许直接申请移民并获得绿卡。

高等学历人员自行评估方法

1、你是否有硕士或硕士以上的学历;     2、你是否在国内国外在本领域有一定的工作经验;
3、你是否获得过国内国外的大大小小的奖励(包括学校的奖学等);     4、你是否在国内国外学术刊物上发表过一些研究文章,在这些文章中有多少你是第一作者;
5、你的文章是否有大量独立引用和/或大量下载量
6、你是否能到找到认识和不认识你的专家以及其他本领域的权威人士为你写的推荐信;
7、你是否能够找到有关你的领域和国家利益的联系的材料;
8、你是否是某(几)个行业协会的会员。

问: NIW/EB-1移民申请好处是什么?

答: 不。以前大家有一些误解,认为申请国家利益豁免要同时满足这两个条件。其实,申请人只需证明自己是高等学位专业人员,或者是突出技能国人。证明自己同时满足两个条件是没有必要的。请注意,这只是申请国家利益豁免的基本标准,并不能保证国家利益豁免申请一定会取得成功。

问: 申请国家利益豁免都需要准备哪些文件?
答: 申请国家利益豁免需要递交移民局I-140表格和劳工部ETA-750B表格,以及能够证明申请人是高等学位专业人员或突出技能外国人的相关材料。除此之外,根据移民法规定,没有其他必交的资料。但是,我们建议申请人还应递交由申请人所在的领域内的杰出人士出具的推荐信和由资深移民律师起草的申请书,这些材料也是相当重要的。
在这里,我们再次提醒您注意,仅满足国家利益豁免申请对文件资料的最低要求并不能保证您的国家利益豁免申请一定会取得成功。

问: 移民局对国家利益豁免申请是如何做出最后的处理决定的?
答: 1998年8月之前,美国移民局USCIS(当时称作移民归化局INS)对国家利益豁免采取宽大政策。但是,根据移民局行政上诉办公室(AdministrativeAppealUnit)对1998年8月7日的纽约州交通部案做出的处理决定,国家利益豁免申请的标准被提高了。

在考虑一名外籍人士是否对美国的国家利益会带来实质性的有益影响时,以下三个因素比较重要:
必须证明申请人的工作领域与美国的国家利益有内在的实质的联系;
必须证明申请人所从事的工作会在美国全国范围内产生有益的影响,意思就是,申请人所从事的工作不能仅对美国的某一地区产生影响。
必须证明如果要求申请人先申请劳工证,会对美国的国家利益产生负面影响。申请人必须证明如果这一职位由美国工人担任,是与美国的国家利益背道而驰的。

劳工证申请过程是为了保护与申请人有相同资格的美国人的利益的。申请人必须证明由申请人担任这一职位可以给美国的国家利益带来的有益影响将比由美国员工担任这一职位所所带来的影响大得多。

在所有这些要求中,最基本的就是要满足第三条。几乎所有的工作都可以和国家利益联系上,而且大多数都可以适用全国范围内的标准。比如,在纽约州交通部案中,虽然申请人只在纽约州的桥梁工程工作,但是他成功地证明了他的工作对整个国家的交通系统都会有影响,因为跨州旅行的人都会用到纽约州的桥梁。但是,要想证明第三点是比较麻烦的。所以,我们建议申请人咨询资深的移民律师。

问: 怎样证明申请人的工作在未来可以给美国带来国家利益?
答: 原则是「立足於现在,著眼於未来」。由於国家利益豁免就是以未来可预期的国家利益为基础的,所以最重要的就是证明根据申请人过去的成就,来预期他未来可以为美国的国家利益带来有益的影响。

问: 国家利益豁免申请能否成功是否会非常确定?
答: 国家利益豁免申请的要求是比较抽像的,不是说申请人拥有了哪些文件,达到硬性标准就一定可以成功。相对来说,EB-1(a)和EB-1(b)的要求就比较确定。比如,宋先生获得过十多个国际性的大奖,在专业期刊上又发表过30多篇文章,担任多家期刊的评委工作,多次参与评议他人的作品。这样的条件我们的建议是去申请EB-1(a),因为由于EB-1(a)的要求比较确定,像宋先生这样的条件获得批准的机率的确定性相对就比较大。

问: 申请过程中个人技能和特殊背景的重要性有多大?
答: 只强调申请人的个人技能和特殊背景是不够的,而申请人的个人技能和特殊背景可以为美国带来国家利益才是重要的,而且这种利益应该大於保护美国工人的利益这一国家利益。

问: 在国家利益豁免申请中,谁负有举证责任?
答: 申请人及其律师负有举证责任。

问: 在读博士生可以申请国家利益豁免吗?
答: 可以。因为国家利益豁免不需要雇主提供永久工作职位,所以只要满足条件,在读博士生完全可以申请国家利益豁免。

问: 国家利益豁免对发表作品的数量的最低规定是多少?
答: 移民局对此没有特别规定。由美国移民局对不同的申请案作出不同的要求。当然,如果您发表的作品越多,对您的申请来说也越有利,获得成功的机会就越高。

问: 是否要证明在国家利益豁免申请人的工作领域内出现劳力短缺?
答: 不需要。纽约州交通部案明确指出证明申请人工作领域内出现劳力短缺并不是国家利益豁免申请的考虑因素。

问: 除了国家利益豁免,职业移民还有哪些类别是不需要事先获得劳工证的?

问: 我必须在美国境内才能申请国家利益豁免吗?
答: 不需要。无论您是在美国还是在其他任何一个国家,您都可以申请国家利益豁免。但是,如果您不在美国境内,申请成功的难度会比较大,一是由于您身在美国之外,比较难以证明自己的工作和美国的国家利益之间的联系;二是在美国之外比较难邀请美国的专家学者来为您出具推荐信;三是,对于非英语国家来说,申请人的作品的语言是非英语的,这也是一种障碍。

问: 什么是推荐信?
答: 推荐信一般由申请人的工作领域或相关领域内的专家或权威学者出具的。信的内容主要表明国家利益豁免申请人的能力和成就,以及申请人的工作可以为美国的国家利益带来的好处。在国家利益豁免申请中,推荐信的作用是非常重要的。

问: EB-1/NIW移民申请一定要有推荐信吗?
答: 一般来说需要。但是如果你获得了诺贝尔奖,把你的名片寄过去,表达想移民美国的意向,那边就把绿卡寄过来了,一封信都不需要。不过对一般人而言,如果没有这些“一锤定音”的证据,最好能有推荐信来简明扼要地阐述你的贡献,描画你的影响。

移民官一般没有你的专业背景,他们可以通过推荐信深入浅出地了解你的成就。你展示的成就是物证,专家的话是人证。人证和物证加起来,就是最有说服力的证明。

问: 我应该找谁来为我出具推荐信呢?
答: 获得推荐信的渠道有很多。推荐人,不见得越有名越好。一般说来申请人应该找自己的工作领域内的专家来写推荐信,说明申请人在该领域做出过重要贡献,也获得了高度认可。
其他渠道就是曾经使用过申请人的工作成果的公司的高级领导人员,现任或者以前的雇主。我们还建议您应该获得一些没有和您一起工作过的人士写的推荐信,因为这样的推荐信比由熟知您的人士写的更有份量。
推荐者来源最好广泛一些。不要所有的信都从一个州或者一个学校来。最好有学术界的,应用界的,有民间的,有官方的,有相熟的,有独立的,有本州的, 有外州的, 有美国的,也有国际的。 最好有超过一半的信从和你没有工作关系没有亲属关系的相对独立的人那里获得。从你的母国来的信,一般被认为带有“个人帮忙性质”, 而没有太多说服力。 如果你的所有推荐者都有中国人的名字, 移民官会认为你的影响力局限于你的族群里。

问: 一个成功的国家利益豁免需要多少封推荐信?推荐信越多越好吗?
答: 不是。移民局并没有规定推荐信的数量。一般情况下5到7封就够了。很强的案子可以少一些推荐信。

问: 推荐信要有多长?
答: 一两页就够了。好的推荐信在于“有效信息”而不在于篇幅。 移民官天天看信,时间压力大,越长的信,往往越招他们讨厌。简练,概括,少一些技术上的术语,记载了有效信息的推荐信才是移民官所乐见的。

问: 推荐信的说服力应该有多强?
答: 当然是越强越好。推荐信最好能够热情赞美申请人的能力,天赋,做出的成就还有其工作将会给美国的国家利益带来的有益影响。由于国家利益豁免申请能否成功在很大程度上取决于推荐信,所以我们建议您寻求资深移民律师的协助来准备这些推荐信,这一点非常重要。

关于杰出人才移民EB1a补件

以往,凡是我做的案子很少补件,但是从2018年10月开始补件明显增多。不管是当事人还是我对补件RFE都深恶痛绝,因为补件明显拖长了整个申请流程,一次补件至少要延长申请时间2-3个月。而I140的延后2-3个月,因为EB1A申请人越来越多,可能导致nvc延迟更久。

补件增多的原因可能包括:

1、移民局审核更加严格。目前比较可行的移民美国的方式只剩EB1,申请人数暴增,EB1A也史无前例的出现了排期。

2、部分移民官业务能力低下。有的补件其实是没有必要的,申请人已经提交了足够的证据,仍然被要求补件。

3、部分移民官无法在审理期限结案,通过补件延长审理期限。

我们应该客观地看待补件。2018年9月11日新规明确移民官可以不经过补件,而直接否决移民申请。收到补件,至少说明移民通过的可能性还是比较大的,否则移民官就直接拒了,不用补件这么麻烦。

补件常出现的一个问题是,收到电子邮件补件通知,但是没有收到移民局的快件。电子邮件只是告知需要补件,但要补哪些内容是不知道的。USCIS的服务真的无力吐槽,这时只能要求移民局重新寄出快件。
